1. Agreement to Terms

By accessing or using the CMSX platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

CMSX provides a high-performance headless content management system that enables developers to:

  • Define dynamic content schemas with multiple field types
  • Create, edit, version, and publish content entries via REST API
  • Upload and manage media assets with automatic optimization
  • Control access with role-based permissions (Admin, Editor, Viewer)
  • Deliver content at 12,600+ reads/sec with ~8ms average latency

3. Account Registration

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your account credentials, including your API keys. You must not share your API keys in client-side code, public repositories, or any publicly accessible location.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law
  • Transmit any malware, viruses, or destructive code
  • Attempt to gain unauthorized access to other users' accounts or data
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to store or distribute illegal, harmful, or infringing content
  • Exceed rate limits or abuse the API in a manner that degrades service for others
  • Resell, sublicense, or redistribute the Service without prior written consent

5. API Usage & Rate Limits

The CMSX API is provided for content management and delivery. Content read endpoints are optimized for high throughput (12,600+ req/s). We reserve the right to throttle or suspend access if usage patterns indicate abuse. Authentication endpoints are rate-limited to 5 requests per minute per IP address.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by CMSX and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Your license data, software products, and configurations remain your intellectual property.

7. Service Level Agreement (SLA)

Uptime Commitment

CMSX targets 99.9% uptime for the API and dashboard services. Planned maintenance windows will be communicated at least 48 hours in advance via email and our status page.

Data Integrity

All content is stored with AES-256-GCM encryption at rest. Content versioning ensures you can always roll back to a previous version. Database backups are performed daily with encrypted storage.

8. Payment Terms

CMSX is available as a one-time purchase ($99 for the CMS license). An optional annual renewal ($49/year) provides continued updates and support. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

9. Termination

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time from the Settings page. Upon deletion, we will remove your data within 30 days, except where retention is required by law.

10. Limitation of Liability

To the maximum extent permitted by law, CMSX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to use the Service after those revisions become effective, you agree to be bound by the revised terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CMSX operates, without regard to its conflict of law provisions.
